1. Terms and Conditions

1.1 Your Engagement with Weddingly LLC

Welcome to Weddingly.ai and Weddingly.io (the Platform), operated by Weddingly LLC. These Terms form a binding agreement between you and Weddingly LLC and govern your access to and use of the Platform and any related services, applications, websites, products, and content. Some services may be age restricted and are not available to users under the age of 13. The services are provided for your personal, non commercial use.

For purposes of these Terms, you and your mean the person using the services. By accessing or using the services you agree to these Terms.

If you are under 18, you must have the consent of a parent or legal guardian. Your parent or legal guardian should review these Terms with you before you use the services.

1.2 Agreement Acceptance

By using the services, you confirm that you can enter into a binding contract, that you accept these Terms, and that you will comply with them. Your use is also governed by our Privacy Policy, which is incorporated by reference.

Some features are free and optional add on features may be available for a fee. Your first use of the services is your acceptance of these Terms. We may update these Terms from time to time. If changes materially affect your rights we will notify you by posting on the Platform or by email. Your continued use after changes take effect means you accept the new Terms.

1.2.1 Use of WeddinglyAi Agent

WeddinglyAi Agent uses automated models to generate text, images, and recommendations. Outputs may be inaccurate or incomplete. The Agent is for informational and creative purposes and is not a substitute for professional advice. You are responsible for reviewing outputs and for any decisions or publications based on them.

1.2.2 AI outputs and third party models

The services may generate content using automated systems operated by third party providers. We do not control the content of these outputs and we do not promise accuracy, completeness, or suitability for any purpose. Responsibility for the operation and behavior of those automated systems rests with their providers. To the maximum extent permitted by law, Weddingly LLC disclaims all liability for any errors, omissions, harm, or losses arising from model outputs or from your reliance on them. You are solely responsible for reviewing and validating outputs before use, publication, or distribution, and you agree not to treat any output as a statement or endorsement by Weddingly LLC. Outputs are for informational and creative purposes and are not professional advice.

1.3 Account Management

You may create an account by providing your name, email address, and a secure password. You are responsible for maintaining the confidentiality of your credentials and for all activity on your account. Do not share your credentials or allow others to access your account. If you suspect unauthorized use, contact support@weddingly.ai.

We may suspend or terminate accounts that harm the services, infringe rights, or violate law or these Terms. We may recover or change usernames.

To delete your account, email support@weddingly.ai. Deletion is final.

1.4 Account and Service Guidelines

Accounts are for personal use only. You agree not to share, sell, or transfer your account or to buy or use an account registered to another user, except through features that expressly allow sharing of content.

1.4.1 Prohibited Uses

You will not use the services to create or share content that is unlawful, infringing, deceptive, harassing, hateful, or that violates privacy or publicity rights. You will not upload or generate content that depicts a real person without consent, exploits minors, or is intended to mislead others about a real person. You will not attempt to bypass safety systems, probe or extract models, or interfere with normal operation of the services.

1.5 Face and Likeness Consent

You must have permission to upload, edit, or generate content that depicts a real person. For minors, you must be the parent or legal guardian or have verifiable permission. We may request proof of consent and may remove content or suspend accounts to protect individuals.

1.6 Usage Qualifications

The services are not intended for individuals under 13. We may terminate any account used by someone under 13. You may not use the services if you cannot form a binding contract without guardian consent, if you are a registered sex offender, if you have been banned, or if you do not agree to these Terms.

1.7 Rights and Usage of Content

We grant you a personal license to access and use the services. We retain all ownership and intellectual property rights in the services and underlying models. Subject to your compliance with these Terms and payment of applicable fees, Weddingly LLC grants you a worldwide license to use, reproduce, and display the images and other outputs you generate on the Platform for your permitted purposes, except where third party rights are implicated. You are responsible for clearing any third party rights in prompts, uploads, or outputs. Nothing in this section grants rights in our trademarks or brand assets.

1.8 User Content and Conduct

You are responsible for your conduct and for content you provide. We are not required to monitor content but may remove content that violates these Terms or law.

1.9 Use of Inputs and Outputs for Operation and Improvement

By using the services, you grant Weddingly LLC a perpetual, irrevocable, worldwide, royalty free, and non exclusive license to use your inputs and outputs to operate, secure, and improve the services and our artificial intelligence models. You may opt out of future use for model training by emailing support@weddingly.ai from your account email. We may continue limited use as necessary for safety, abuse prevention, troubleshooting, and legal compliance.

1.10 Third Party Providers

The services may interact with or rely on services, platforms, or APIs provided by third parties. These providers operate their own services and are outside our control. We do not endorse or assume any responsibility for those services. If a third party service becomes unavailable, changes, or imposes limits, we may change, suspend, or remove features that depend on it without liability.

1.11 Moderation and Reporting

We use automated and human review to detect harmful or restricted content. You can report content or behavior at support@weddingly.ai. We may remove content, limit features, or suspend accounts to protect users and comply with law.

1.12 Free Services, Rate Limits, and Credits

We may offer free services, credits, or tools. We may apply rate limits or credit caps. Free promotional credits may expire as shown in your account.

1.13 Service Availability and Modifications

We do not guarantee continuous or error free access. We may modify, suspend, or discontinue any part of the services.

1.14 Limitations of Liability

To the maximum extent permitted by law, Weddingly LLC will not be liable for indirect, special, incidental, consequential, or exemplary damages. Our total liability for any claim will not exceed the greater of fifty dollars or the amounts you paid in the twelve months before the claim.

1.15 Export Controls and Sanctions

You represent that you are not subject to sanctions and will not use the services in embargoed locations or for prohibited end uses.

1.16 Copyright Notice and Takedown

If you believe content infringes your copyright, send a notice to support@weddingly.ai with your contact details, identification of the copyrighted work, the location of the allegedly infringing material, a good faith statement, and your signature. We may remove material and may terminate repeat infringers.

1.17 Claims, Disputes, and Governing Law

These Terms are governed by the laws of the State of Texas. You agree to the exclusive jurisdiction of the state and federal courts in the State of Texas, with venue in the county where Weddingly LLC then maintains its principal place of business.

1.18 Amendments

We may modify these Terms at any time. If changes materially affect your rights, we will notify you. Your continued use after changes take effect means you accept the new Terms.

1.19 Termination

We may suspend or terminate your access at any time. Upon termination, your right to use the services ceases immediately.

1.20 General Provisions

If any part of these Terms is invalid or unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Weddingly LLC regarding the services.

1.21 EU Digital Services Act Information

Point of contact for users and authorities is support@weddingly.ai. To report allegedly illegal content, include the URL or location, a description of why it is illegal, and your contact details. We use automated and human moderation. We will publish transparency information if required by law.

2. Payment Conditions

2.1 Digital Goods

Weddingly LLC offers access to features including services, credits, loyalty points, and digital tokens. Digital goods are licensed, personal, non transferable, revocable, and for personal non commercial use. Purchases through Apple App Store or Google Play are governed by those platforms.

2.2 Store Purchases and Auto Renew

Store providers process billing, renewals, cancellations, refunds, and taxes. Manage or cancel subscriptions in the store settings. Subscriptions renew each period until you cancel.

2.3 Refunds and Irrevocable Transactions

Purchases of consumable credits are final and non refundable except where required by law or by the store.

2.4 Taxes

Prices may exclude taxes. We collect and remit applicable taxes where required. You are responsible for bank or currency fees.

2.5 Trials and Promotional Credits

Trials and promotional credits may have limits and expiration dates. If you do not cancel before a trial ends, the paid subscription begins at the posted rate.

2.6 Chargebacks and Fraud

We may suspend or terminate accounts associated with chargebacks or suspected fraud.

3. Privacy Policy

At Weddingly LLC we take privacy and security seriously. This Privacy Policy explains how Weddingly LLC collects, uses, shares, and protects information in connection with Weddingly.ai and Weddingly.io and related services. By using the services you consent to this policy.

3.1 Interpretation and Key Definitions

Account means a unique account created by you to access the services. Personal Data means information about an identified or identifiable person. Service means the Platform and related services. Usage Data means information collected automatically by the service such as device information and log data. You means the individual using the service, or the company or other entity on whose behalf an individual uses the service.

Images, prompts, outputs, and account data are processed and stored on Amazon Web Services in the United States. Original uploads used for editing are processed and are not stored long term unless you choose to save a project.

3.5 Sharing and Processors

We share data with service providers that support hosting, artificial intelligence processing, payments, analytics, customer support, and content moderation under data protection agreements.

3.6 AI Training and Opt Out

We may use your inputs and outputs to operate, secure, and improve the service and our models. You may opt out of future use for model training by emailing support@weddingly.ai from your account email.

3.7 Sensitive and Biometric Information

We do not create or store biometric identifiers. Where local law treats face images as biometric information, you consent to processing solely to perform requested editing and generation features.

3.8 Cookies and Preferences

We use cookies and similar technologies for necessary, functional, analytics, performance, and advertisement purposes. EU users can manage preferences through our cookie banner.

3.9 Data Retention

We retain personal data only as long as needed for the purposes described in this policy or as required by law.

3.10 Your Rights

Subject to law, you may request access, correction, deletion, and portability of your personal data. You may object to or restrict certain processing. Submit requests to support@weddingly.ai.

3.11 Children

The service is not directed to children under 13 and we do not knowingly collect personal data from children.

3.12 Security

We use industry standard measures including encryption in transit and at rest, access controls, and monitoring. No method is perfectly secure.

Your data may be processed in the United States and other countries. We use appropriate safeguards for cross border transfers.
